1. Code of good practices
Our mission is to empower African descendants all over the world that take part in tourism. By offering a platform specially designed for people of African descent who are active in tourism. For people among us who are active as tourists and/or active as tourism activity owners. To achieve this mission Book and Visit Afro Abroad makes sure to:
• Be flexible and create the right (online) tourism programs for you;
• Offer different online services for your different needs at different moments;
• Be able to serve you in different languages. The services are available in the languages: English, Dutch, French, Spanish, Portuguese, and Cape Verdean Creole;
• Have different methods of contact. Book and Visit Afro Abroad can be contacted by phone, mobile communication applications, e-mail, social media messengers, and the contact form on the website;
• Give you the possibility to choose your favorite payment methods;
• Be authentic and offer you the best authentic local experiences through online virtual tours and/or physical tourism attractions programs on destinations.
• Book and Visit Afro Abroad respects your privacy, in our Privacy Statement you can read how your privacy is respected.
2. Definitions
In this Terms and conditions we use the definition and meaning of the terms as written below:
• Terms and conditions mean the Terms and conditions from Book and Visit Afro Abroad;
• Services; means the personal services that are offered by Book and Visit Afro Abroad. The four services are Online virtual tours, Travel planner and assistant, Black-owned tourism activities programs, and African heritage tourism activities programs;
• Activity means the tourism attraction and/or leisure excursion offered by third parties that are added to your travel programs through our services as intermediaries’. These activities are not produced or organized by Book and Visit Afro Abroad. Examples of activity: tours, visits to museums, dinners at restaurants, visiting stores, etcetera;
• The agreement means the agreement between the consumer and Book and Visit Afro Abroad for the activity purchase and receiving the tickets;
3. Features of the personal services
The personal services from Book and Visit Afro Abroad are created and offered by Book and Visit Afro Abroad itself. It is a service Book and Visit Afro Abroad offers to help people search through the many options online to find activities that fit their desired local experiences. We are specialized in creating tailor-maid activity programs, existing of the many local tourist attractions at specific destinations. All services mentioned on the website are specifically for creating activity programs to complete your local experience.
4. Use of the terms and conditions
• These terms and conditions apply to all services offered at Book and Visit Afro Abroad.
• In addition to the services for tailor-made activity programs and online virtual tours, the terms and conditions of the activity owners are also applicable to the agreement. If there is a major conflict between the terms and conditions of Book and Visit Afro Abroad and the terms and conditions of the activity owners, the terms and conditions of Book and Visit Afro Abroad will be a decisive factor. The Activity owners will send you their terms and conditions on request.
• The consumer will have to agree with the fact that the terms and conditions of the activity owners can be applied to the agreement and travel programs.
• These terms and conditions can apply to all the activities chosen and added in a tailor-maid travel program by and from Book and Visit Afro Abroad.
5. Prices and offers
• All offers are tailor-made services. Centered on creating activity programs, existing of different kind of local tourism attractions at specific destinations.
• Book and Visit Afro Abroad is specialized in creating tailor-maid activity programs. However, only if an activity program is booked at Book and Visit Afro Abroad, there’re exceptions made for the searching and booking from accommodations, transport, travel assurances, and flights. This exceptional service for accommodation, transport, travel assurances, and flights are not available on its own.
• All the prices of the services are starting prices. Because of the tailor-maid feature of the services, it is not possible to offer one fixed price for all programs.
• All services need a prepayment that consists of the starting price mentioned on the website and/or the agreement between the consumer and Book and Visit Afro Abroad. After this prepayment, the tailor-maid activity program or virtual tour will be created. When the program is excepted by the consumer, the consumer will receive an invoice with the total price of the agreed program. At that moment, the consumer is required to pay the total amount mentioned on the invoice. After receiving that prepayment, the bookings will be done.
• If the payments are not done on time, it can lead to an immediate cancellation of the agreement. In this case, the terms and agreement for cancellations (as below) will be
applied. The already paid amount will be used to pay the cancellation costs. If the amount doesn’t cover all the costs, a new invoice will be sent for the rest of the amount due.
• Book and Visit Afro Abroad keeps the right to change prices without obligations.
• All prices are mentioned in euro’s inclusive TAX.
• In some cases, promotional prices are applied. These prices are limited for a specific period and time. These special prices cannot be used to change any regular price of services.
• Book and Visit Afro Abroad cannot be held liable for prices that are visibly incorrect on the website or agreement. Book and Visit Afro Abroad will not have any obligations to deliver the service at that particular incorrect price.
• For each service, Book and Visit Afro Abroad charges fixed service costs, that can vary per type of service and/or activity added in travel programs. The costs include among other things: transaction costs, consultation costs, and administration costs.
6. Cancellations and/or modifications from the consumer
• Book and Visit Afro Abroad believes in a personal after service. The terms and conditions below can be adjusted to each particular situation. Always contact us personally so we can look at your special case and search for a suitable solution.
• The activity owners are authorized to cancel the activity or change the date and time. Book and Visit Afro Abroad will search for the best possible solution for the consumer. If the activity owners change or modify an activity that is already booked and paid, Book and Visit Afro Abroad will inform the consumer as soon as possible. But, Book and Visit Afro Abroad cannot guarantee that the information will be communicated ‘’on-time’’ for the consumer. Also, Book and Visit Afro Abroad will not be responsible for paying back the costs you would like to get back. Such as travel, accommodation or other services costs you may have had.
• Tickets included in the programs, with a specific time and date, which means tickets with a time lock, are not exchangeable most of the time. Tickets that don’t have a specific time and date, can be exchanged in some cases.
• Book and Visit Afro Abroad will not be held liable for damaged, wrongfully used, or lost tickets. The tickets will not be refunded by Book and Visit Afro Abroad.
• Book and Visit Afro Abroad will not be held liable for your delays, or if you don’t deliver your tickets correct at the activity.
• If an already purchased ticket is not used, it is on your own account and risk. This is also the case for the tickets from activities that have a specific time and date.
• The consumer will have to pay cancellation costs in some cases. The amount of the costs is based on the nature of each situation. However, the cost will consist of minimum the starting price of the purchased services as mentioned on the website and/or agreement between the consumer and Book and Visit Afro Abroad.
• to reschedule or cancel, the consumer will have to pay a fee starting at 25% of the total program costs, and/or the extra costs that come with modifications. The exact fee % are:
• 25% of the total costs if it’s canceled between 56days and 28days in advance of the date of the activities. However, the cost will consist of minimum the starting price of the purchased services as mentioned on the website and/or agreement between the consumer and Book and Visit Afro Abroad.
• 35% of the total costs if it’s canceled between 28days and 21days in advance of the date of the activities. However, the cost will consist of minimum the starting price of the purchased services as mentioned on the website and/or agreement between the consumer and Book and Visit Afro Abroad.
• 45% of the total costs if it’s canceled between 21days and 14days in advance of the date of the activities. However, the cost will consist of minimum the starting price of the purchased services as mentioned on the website and/or agreement between the consumer and Book and Visit Afro Abroad.
• 85% of the total costs if it’s canceled between 14days and 7day in advance of the date of the activities. However, the cost will consist of minimum the starting price of the purchased services as mentioned on the website and/or agreement between the consumer and Book and Visit Afro Abroad.
• 95% of the total costs if it’s canceled between 7days and 1day in advance of the date of the activities. However, the cost will consist of minimum the starting price of the purchased services as mentioned on the website and/or agreement between the consumer and Book and Visit Afro Abroad.
• 100% of the total costs if it’s canceled the same day of the date of the activities. However, the cost will consist of minimum the starting price of the purchased services as mentioned on the website and/or agreement between the consumer and Book and Visit Afro Abroad.
• Cancellations and modifications communicated out of office hours will have the cancellation or modification date of the upcoming workday.
7. Cancellation and/or modifications from Book and Visit Afro Abroad
• If Book and Visit Afro Abroad cancels or makes a modification, the consumer will be offered a new activity program that is equivalent to the original program. The consumer will get restitution of the difference in price if that is the case.
• In the case of Force majeure, Book and Visit Afro Abroad can not be held responsible for canceled activities and programs.
• Special circumstances and local conditions may result in cancellations or modifications of the activity programs before or during the time that the activities would take place. In this case, Book and Visit Afro Abroad will be obligated to offer alternatives to the consumer. Book and Visit Afro Abroad will take into account the personal needs of the consumer and retain the unique tailor-maid characteristic of the services of Book and Visit Afro Abroad. These changes could cause extra costs to the consumer.
• The consumer can refuse the alternatives, only if it’s not reasonable and far out of the context of the initial desired tourism experience.
8. Payments, Delivery & Liability
• All the services are partially prepaid. The starting price has to be paid before the first meeting or conversation.
• Book and Visit Afro Abroad accepts different payment methods. The payment in Euro’s need to be done by PayPal, Credit Card, Ideal, (international) money transition organization such as Western Union or live physical transition. You will get the final confirmation of your purchase, when the money is received by Book and Visit Afro Abroad.
• The tickets for the activities will be delivered online. You’ll receive your tailor-made travel program including the tickets via e-mail within a mutually agreed time.
• If the promise to deliver within the agreed time is not fulfilled by Book and Visit Afro Abroad, it won’t give any right for cancellation. Unless the delay is of such severity that it is not possible to do the activities anymore.
• You must check if the delivered tickets and tailor-made programs are along the agreements made with Book and Visit Afro Abroad. If it’s not the case, you have to
inform Book and Visit Afro Abroad in writing as soon as possible, within 3 days after delivery. Mention the relevant reason why it does not match with the agreement.
• If the reason is recognized by Book and Visit Afro Abroad, the tickets and travel programs will be either changed or refunded.
9. Electronic correspondence and communications
• Book and Visit Afro Abroad cannot be held accountable for misunderstandings, delays, or incorrect transmission of information and messages as a result of the use of the internet between the consumer and Book and Visit Afro Abroad.
• The information of Book and Visit Afro Abroad serves as proof of existence and implementation of the agreement in a legal proceeding.
10. Force Majeure & Liability
• Force majeure means all the shortcomings that cannot be allocated to Book and Visit Afro Abroad. Because it cannot be seen as the responsibility of Book and Visit Afro Abroad by the law, legal proceedings, or generally accepted standards.
• The consumer and/or user of the tickets must behave as a good visitor and follow the rules that are given to him or her. The rules of the activity owners and the government.
• Book and Visit Afro Abroad cannot be held liable for any rejection from the activity owners or government organization, as a result of negligence or actions of the consumer.
• The buyers of the ticket will visit the activity at their own risk. Book and Visit Afro Abroad cannot be held liable for any injury that the consumer gets while doing the activity or on the way to and from the activity.
• The Dutch Law is applied to all agreements with Book and Visit Afro Abroad. Every conflict will be represented in the Court of Rotterdam.
• Book and Visit Afro Abroad can only be held liable for direct damages suffered or paid, if the damage is caused by a shortcoming of the obligations of Book and Visit Afro Abroad as said in these terms and conditions.
• Book and Visit Afro Abroad cannot be held responsible for damage that should or/and is covered by travel, liability, and/or cancel insurances.
• Book and Visit Afro Abroad cannot be held responsible for any damage caused by inappropriate behavior of the consumer at the activity or other local places at the destinations.
11. Book and Visit Afro Abroad intellectual property
• The content shown on this website is owned by Book and Visit Afro Abroad. You are not entitled to copy, hyperlink, promote, market, or offer the content as your own.
